Sexual Harassment Reporting

Sexual Harassment:

Sexual harassment is a form of sex discrimination, which is illegal. Sexual harassment includes unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when made by a member of the school staff to a student or when made by a student to another student where:

  1. Submission to such conduct is explicitly or implicitly made as a term or condition of an individual’s education; or

  2. Submission to or rejection of such conduct is used as a basis for education decisions affecting such individual; or

  3. Such conduct has the purpose or effect of substantially interfering with an individual’s educational performance, or creating an intimidating, hostile, or offensive education environment.

Sexual harassment may include, but is not limited to:

  1. Suggestive or obscene letters, notes, touching, invitations, slurs, jokes, derogatory comments, impeding or blocking movement, gestures, or display of suggestive objects, pictures, or cartoons.

  2. Continuing to express sexual interest after being informed that the interest is unwelcome. Reciprocal attraction between peers is not considered sexual harassment.

  3. Implying or actually withholding grades earned or deserved; or suggesting that a scholarship recommendation will be denied.

  4. Engaging in coercive sexual behavior to control, influence, or affect the educational opportunities, grades, and/or learning environment of a student.

  5. Offering/granting favors or educational benefits, such as grades/promotions in exchange for sexual favors.


Any student who is subject to sexual harassment, or who knows of the occurrence of such conduct, should immediately inform the administration. A substantiated charge against a student shall subject that student to disciplinary action, which may include suspension or expulsion. Matters involving sexual harassment will remain confidential to the extent possible.

Student Concerns:

Students may present a complaint or grievance regarding one or more of the following:

  • Violation of the student’s constitutional rights

  • Denial of equal opportunity to participate in any program or activity for which the student qualifies not related to the student’s individual capabilities.

  • Discriminatory treatment on the basis of race, color, religion, sex, age, national origin, or disability.

  • Harassment of student by another person.

  • Intimidation by another student.

  • Bullying by another student

  • Concern for the student’s personal safety.

Provided that (1) The topic is not the subject of disciplinary or other proceedings under other policies and regulation of this District, and (2) The procedure shall not apply to any matter for which the method of review is prescribed by law, or the Governing Board is without authority to act.
